Terms of Service

These Terms of Service govern your access to and use of the websites, software, mobile applications, and services provided by SoftForge Digital LTD and SoftForge Digital SARL (together, 'SoftForge Digital', 'we', 'us'). By using our services, you agree to these Terms.
1. Acceptance of Terms
By accessing or using our services, you confirm that you can form a binding contract with SoftForge Digital, that you accept these Terms, and that you agree to comply with them. If you do not agree, do not use our services.
2. Services
We provide custom software development, SaaS platforms, mobile applications, fintech and payment solutions, automation systems, AI-powered tools, and related services. Specific features, pricing, and service levels may be set out in separate agreements or order forms.
3. Eligibility and accounts
You must be at least the age of majority in your jurisdiction to use our services. If you create an account, you are responsible for keeping your credentials confidential and for all activity that occurs under your account.
4. Acceptable use
You agree not to misuse our services. In particular, you may not:
- Violate any applicable law or regulation
- Infringe the intellectual property or other rights of any party
- Upload malicious code, spam, or attempt to disrupt service
- Reverse engineer, decompile, or attempt to extract source code, except as permitted by law
- Use the services to harass, defraud, or harm others
5. Intellectual property
We and our licensors retain all rights, title, and interest in and to our services, software, content, trademarks, and other intellectual property. Except for the rights expressly granted to you, no other rights are transferred. Where a separate agreement governs custom development work, that agreement controls allocation of intellectual property in deliverables.
6. Third-party services
Our services may integrate with or rely on third-party platforms (cloud providers, payment processors, analytics, etc.). Your use of those third-party services is subject to their own terms.
7. Disclaimer of warranties
Except as expressly set out in a separate signed agreement, our services are provided 'as is' and 'as available' without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
8. Limitation of liability
To the maximum extent permitted by law, SoftForge Digital and its affiliates, directors, employees, and agents will not be liable for any indirect, incidental, consequential, special, or exemplary damages, or for loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the services. Our aggregate liability for any claims arising under these Terms will not exceed the fees you paid to us for the relevant service in the twelve (12) months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless SoftForge Digital from any claims, damages, liabilities, and expenses arising from your breach of these Terms or your misuse of the services, except to the extent such claims arise from our gross negligence or willful misconduct.
10. Termination
We may suspend or terminate your access to our services at any time for breach of these Terms or for any other reason permitted by law or our agreements with you. Provisions that by their nature should survive termination will survive.
11. Governing law
Unless a separate signed agreement specifies otherwise, services delivered by SoftForge Digital LTD are governed by the laws of England and Wales, and services delivered by SoftForge Digital SARL are governed by the laws of the Kingdom of Morocco. The competent courts of London (for LTD) or Tangier (for SARL) will have exclusive jurisdiction.
12. Changes to these Terms
We may update these Terms from time to time. The 'Last updated' date at the top reflects the latest revision. Continued use of our services after changes constitutes acceptance.
